Asylum in Canada

The Manifest Border, a legal blog focussed on immigration, pointed me to this story in the Washington Times:

Thousands of illegal immigrants from Middle Eastern countries are seeking asylum in Canada, massing in run-down motels and refugee sanctuaries on the U.S. side of the border, where they are sheltered —- and sometimes hidden —- from the immigration service.

Some, like Mustafa, are assisted by U.S. government-funded agencies until their hearing with Canadian officials.

[…]U.S. officials yesterday said they typically support the refugee services and that their benefits outweigh their harboring of illegals.

“It becomes a matter of how these [illegals] are being advised,” said Bill Strassberger, a spokesman for the Bureau of Immigration and Customs Enforcement. “If they are being told to avoid the law, then it would be something we would look into.” He added that the aliens who are leaving the country are besieging refugee shelters more than the immigration service. A spokeswoman for Canada’s immigration service declined to comment on the situation.

Since fall, when the registration deadline kicked in, Freedom House, a 35-bed refugee facility at the foot of the Ambassador Bridge, has seen an increase of 275 percent in refugee claims to Canada, from 70 last year at this time to 263 this year.

“We started with Iraqis in the fall and moved on to Pakistanis” who were leaving the United States for Canada, said David Koelsch, a staff lawyer at Freedom House. Until recently, “90 percent of our work has been getting people asylum in the U.S.,” he said. “But now, they know that to go before the INS is to be deported and to be locked up in jail while they wait to be deported.” Freedom House received 63 percent of its $844,691 income last year from U.S. government grants, according to records.

An immigration official in Detroit, speaking on the condition of anonymity, did say that any U.S. agency that assists illegals in eluding registration is “helping them circumvent the law.” “We can take [illegals] in if they are not here for a valid purpose. But is not always easy finding them,” the official said.

Now, being an illegal immigrant is a separate matter, but “eluding” special registration by leaving the US before the deadline is entirely legal according to BCIS (or whichever agency replaced the INS).

Who Must Register (Group 3)?

If you are in this category you must register at a designated Immigration Office on or before March 21, 2003.

  • If you are a male born on or before January 13, 1987, and
  • If you were inspected by an immigration officer and last admitted to the U.S. as a nonimmigrant on or before September 30, 2002
  • If you did not have an application for asylum pending on December 18, 2002, and
  • If you will be in the U.S. at least until March 21, 2003.

So, if you leave the US before March 21 (or whatever the deadline for your group is), then you are not required to register.

    I am a Cameroonian from the North West Province.I,m a militant of the only credible opposition party in Cameroon SDF, and an activist of the SOUTHERN CAMEROON NATIONAL COUNCIL,an organization fighting for the total independence of Southern Cameroon.In 1997 I was arrested ,detained,tortured an eventually amputed.I fled the country in 2001 following a warrant of arrest issued against by the chief of secret police.My father was arrested and tortured to death in Oct.2001 in an attempt to extract information on my whereabout .Since then I have been living in the USA where I have been denied asylum and threatened with deportation.Now am scared to death to return to Cameroon because I know what awaits me there.
    Please advise me on how to get and ASYLUM in Canada where I would love to spend the rest of my useful live. Chris.

I’m a Cameroonian by nationality and was an activist of the SOUTHERN CAMEROON NATIONAL COUNCIl(SCNC),A movement fighting independence of Southern Cameroonians.I was arrested on 23 october 2004,detained,tortured until i went unconscous and taken to the hospital,where I fled into nigeria and with the help of the SCNC they sent me to hong kong since is a visa free.My father was arrested and tortured on november 27 2004 to give details on my whereabout .Since then I’ve been living in the china where I’ve been denied asylum or residency permit and they asked me to leave china before 12 match 2005 or faces prisonment.i can’t go back to cameroon i need somewhere to to start a new life i’m just confused i wish you people can help me.i want you do give me an asylum into canada,i’ve authentic proves of my claims.thank you and i wait for your reply….

    Now my asylum is rejected from norway and will be very willing to seek asylum in canada so i can continue my studies as my dreams were.And hopefully will live the rest of my life in canada where i will will support the country in all i can.
    I will bu much great to hear from the immigration board for what advice for me and how can seek asylum in canada.i am now in norway illegally,and does not admire living here illegally.

  29. Sir, I am working for an organization since 1989 and currently, heading a station. On behalf of the management, I registered around 25 criminal cases against employees/outsiders who were involved one way or the other in embezzlement and corruption, in the station, I am heading. These cases were registered from the year 1998 to 2002. Out of the above 25 cases, some were withdrawn by the organization after reaching an agreement/deal with the offenders. While other cases are under process in court of law. Some of the offenders nominated in these cases are either on bail or absconding. And due to the slow process and procedures of courts in Pakistan, the cases are lingering on from the last eight/nine years, with no apparent results.

    Secondly, there is an ethnic/religious group active in the organization. This group has captured top slots of the organization with in a short period of time and now influencing almost every decision in the organization.

    Sir, I have depleted my youth for the organization and now from the last few months, I am continuously receiving threats on life and family, from unknown people due to which, I am feeling insecure and with the passage of time, I am developing a constant apprehension of terror and anxiety. I have all the proofs regarding the above cases while the nature of pressure ethnic/religious group can be studied.

    Sir, I wish to seek asylum in Canada due to fear and threats. I posses a valid Canadian Visa for self. Sir I have a wife and five kids aged between 2 to 13 (four daughters and one son).

    After them I began writness coloumns in news paper ( because I am very like writness books coloumns ) I wrote few coloumn in daily news paper WAHDAT who is published from Peshawar.
    Sir some people camed against me, they began propaganda against me and one day I received a post letter from one of militants comondor (ABC ) who is the the active comondor of militants organization ( XYZ) and also this letter wrote on this organization letter book, and remember it they sent me one meganzine, this meganzine had an killing activity of this organization in Pakistan, so they given me warning of killness, then I continioued my activity, after some days I received a phone calls on my cell phone from above organization but I did not afraid from him.
    One day when my mother was patient and we were ( me my mother and small brother) went to hospital, remember it this hospital is near of above organization members residences (this area is popular with this organization and majority of this organization are living here), so when we reached to this area suddenly some unknown people started fire on us, thanks of God we saved after my mother treatment ( she was very afraid and nervous through this accident ).
    So I got cell numbers, meganzine and also letter of this organazation and came to nearest police office and want to record report against these people , but unfortunatly they did not given us possitive response and did not took any response against these peoples because the govt have to oblige from many resourcess…………….
    Some kindhearted advised me that to leave Pakistan immediately , so I accepted and came to Afghanistan Herat with my one of my dearly friend .

    These days my life is very difficult and very unsafe .
    Also here some kindhearted people advised me to contact with Canada govt and human right comission ( because Canada have many kindness with Afghanistan .)
    So I am sending my request, I want yours helps and shelter under Canada peoples , because I know the people of Canada is completely favours of human rights .

I had been jailed twice in the Republic of Cameroon for being a member of the Southern Cameroons National Council and the Southern Cameroons Youth League, the youth wing of the SCNC. Both organizations peacefully advocate for the independence of the English-speaking Southern Cameroon states from the oppressive French-speaking regime of the Republic of Cameroon, led by President Paul Biya.Over the course of my two imprisonments,I spent over eight months in jail in 1999 and 2000, during which time i was often beaten, tortured and interrogated about my knowledge of, and participation in, the SCNC and SCYL.I fled the country on may 22th 2007 few two days after the national day of LA REPUBLIC DE CAMEROON following a warrant of arrest issued against me by the chief of secret police. The police also brutalized and arrested my father and brother and my wife,who was beaten so badly that she miscarried and spent three weeks in the hospital. in an attempt to extract information on my whereabout.Now im in russia seeking for an asylum in canada since russia refused to grant me asylum nor residence permit.
