Asylum in Canada

The Manifest Border, a legal blog focussed on immigration, pointed me to this story in the Washington Times:

Thousands of illegal immigrants from Middle Eastern countries are seeking asylum in Canada, massing in run-down motels and refugee sanctuaries on the U.S. side of the border, where they are sheltered —- and sometimes hidden —- from the immigration service.

Some, like Mustafa, are assisted by U.S. government-funded agencies until their hearing with Canadian officials.

[…]U.S. officials yesterday said they typically support the refugee services and that their benefits outweigh their harboring of illegals.

“It becomes a matter of how these [illegals] are being advised,” said Bill Strassberger, a spokesman for the Bureau of Immigration and Customs Enforcement. “If they are being told to avoid the law, then it would be something we would look into.” He added that the aliens who are leaving the country are besieging refugee shelters more than the immigration service. A spokeswoman for Canada’s immigration service declined to comment on the situation.

Since fall, when the registration deadline kicked in, Freedom House, a 35-bed refugee facility at the foot of the Ambassador Bridge, has seen an increase of 275 percent in refugee claims to Canada, from 70 last year at this time to 263 this year.

“We started with Iraqis in the fall and moved on to Pakistanis” who were leaving the United States for Canada, said David Koelsch, a staff lawyer at Freedom House. Until recently, “90 percent of our work has been getting people asylum in the U.S.,” he said. “But now, they know that to go before the INS is to be deported and to be locked up in jail while they wait to be deported.” Freedom House received 63 percent of its $844,691 income last year from U.S. government grants, according to records.

An immigration official in Detroit, speaking on the condition of anonymity, did say that any U.S. agency that assists illegals in eluding registration is “helping them circumvent the law.” “We can take [illegals] in if they are not here for a valid purpose. But is not always easy finding them,” the official said.

Now, being an illegal immigrant is a separate matter, but “eluding” special registration by leaving the US before the deadline is entirely legal according to BCIS (or whichever agency replaced the INS).

Who Must Register (Group 3)?

If you are in this category you must register at a designated Immigration Office on or before March 21, 2003.

  • If you are a male born on or before January 13, 1987, and
  • If you were inspected by an immigration officer and last admitted to the U.S. as a nonimmigrant on or before September 30, 2002
  • If you did not have an application for asylum pending on December 18, 2002, and
  • If you will be in the U.S. at least until March 21, 2003.

So, if you leave the US before March 21 (or whatever the deadline for your group is), then you are not required to register.

I was detained,tortured, my elder brother & father were arrested & torture.I fled to USA with student visa but didn’t have money for school.     I am a 23 years old Afghani. I have been living in Austria for nearly 1 and half years. I fled Afghanistan due to well founded fear of persecution in 2001. In May 2002 I entered UK and lived there for 4 years. During this 4 years I studied English and Access to Higher Education (Information Technology) at Oxford and Cherrwel College Oxford. I was offered a place to study at Oxford Brooks University as well, but before I could start studying there the UK’s govt. found my fingerprints in Austria and I am deported to Austria. Now, I have got a negative answer here and anytime could be deported to Afghanistan. Dear Sir or Madam I have well founded fears of persecution there I am not able to go back.   23. I am a Congolese from tutsi and alur tribes in eastern DRC, living now in Kampala Uganda, the only happy period of my life was before 6 years old. My parents stragled beyond impossibility to offer me a somehow education up to senior 4 in high school. Then the war got me scattered from my family for years. I started to run, hide, be hunted, starve, becoming weakly slander, desire little things that I can’t afford such as food, bed, shoes, wears…I couldn’t permanently settle in a town due to instability of armed conflicts which surge many times during a year may it be in Ituri or in north/south Kivu where my relatives live. I tragically lost Mam and many family members. I still have scars from those attacks on me. Unliveable,I left for Rwanda then I came to Uganda where no support is given to us.What’s terrible now is that my 2 younger brothers are still stuck in war zone in Congo, yet I am the only person supposed to help them. Today,I live with my dad with my other sisters and brothers from my father. Things ar very very bad, no jobs, we had very terrific experience in the camp, no NGO support to us, we wrote for durable solution to the UNHCR but as there are many other refugees cases, we shall be waiting for years for our file to be on the table to start a process of solution.
    My request is:
    – help me,guide me in to ways that will take me and my family to a resettlement and asylum to Canada for better existence, for completing our studies, for getting any job, for having hoe in the future. We have so much potential to be useful to your contry’s need.
    – if you do not thing beleive me, we will be lost, perish of nonsense reason, just because people did not payed attention to our situation.
    – we are at the end, I fill it either we dye or we got save to a better livelihood and recover our dignity.
    – If yourself cannot do anything, please refer us to an organisation that can sponsor us. it’s our last game.
    – i have survived so many times and the only thing I keep from it is the people who got me out of it.
